Fines for Failing to Comply
From the 1st of July in 2021, if a new, renewed or varied contract is signed on an Arakura rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.
As of 1st July 2021, when a brand new or renewed Tenancy is signed for the Arakura rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.
Failure to comply with each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement it could result in an additional penalty or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or the property manager doesn’t provide the required information within 21 days from having received the inquiry, they can receive an infringement notice and be fined upto $750.
Furthermore, there’s an additional fine of as much as $900 for property owners or property managers who provide a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person leasing the property out which could be the landlord’s name or the company that manages the property.
All the information on the Compliance Statement requirements to be accurate before the tenancy agreement can be signed, and ideally it is updated through the tenancy period as necessary work related to it’s finished.
It’s also crucial to remember that a landlord who manage multiple rental properties could face more severe penalties for not complying. The highest penalties are given for the most serious breaches, and landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in the case of hearing claims.
