Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on an Arakura rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

Tenancies signed between 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory to all Arakura and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of when the tenancy first began.
