Fines for Failing to Comply

As of 1st July 2021, once a new, renewed or varied tenancy is signed for an Arakura rental property, all Healthy Homes compliance work must be done inside of 90 days.

Landlords with six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 to 30 , June 20,21

  • Ceiling and underfloor insulation is a requirement throughout Arakura and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the conformance to any Healthy Homes Standard that apply or will be in force during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties conform to the Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All the boarding homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From 1 July 2023

  • All homes that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole, then it is likely a crack or hole that needs sealing in somehow. Large gaps and cracks should be permanently stopped. Gaps greater than 3mm that let air in or out within your home need the sealing. For example, if an open fireplace is not in use, it can create draughts. This should be blocked off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as far as possible.

You don’t need to cover up holes or gaps that are part of the building. For instance, small gaps around doors and windows may be required to allow movement of the structure when the house heats and cools, to allow them to be closed and opened rather than being stuck. Heating Arakura

Arakura rental properties should have a permanent source of heat that is able to heat the principal or the biggest living room to at least 18degC, even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs to remain fixed (i.e., not portable) that is, at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool can be used to determine whether the fix heater(s) are sufficient or whether you will require to ‘top up’ with an additional heater. Fires that are open and unflued heaters such as small portable LPG bottle heaters aren’t considered to be suitable heating options in The Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, it must be equipped with the thermostat. This makes the heating more uniform and efficient. In most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In certain situations, like small apartment buildings an electric, fixed heater may be sufficient.

If your living space already has a permanent heating source, like a heat pump, then it may require an update in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Arakura

Every living space in a rental property must have at least one opening doors or windows to provide natural ventilation. In addition, high moisture areas such as kitchens or bathrooms should have an externally vented extractor to remove moisture.

Insulation Arakura

The insulation of the ceiling and underfloor has been compulsory to all rental homes since July 1, 2019. All landlords and property managers have to make sure that the insulation is in line with this new standard. In some instances, existing ceiling insulation or insulation in the sub floor space might need to be replaced or replaced.
