Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on an Arakura rental property, all Healthy Homes compliance tasks have to be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Arakura rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Inability to adhere to any of the Healthy Homes Standards within the deadlines can result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy contract, there may be an additional fine or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the information requested within 21 days of getting the notice, the tenant will receive an infringement notice and be fined as high as $750.

Furthermore, there’s also a penalty as much as $900 for property owners or property managers providing a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is the person who is named on the tenancy agreement as being the person who is letting the property, so it could be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance requirements to be correct at the time that the tenancy agreement is executed, and it is updated throughout the tenancy as any relevant work gets completed.

It is important to note that landlords who have multiple rental properties may face additional fines for non-compliance. The harshest penalties are handed down for the most serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

When do I require to be in compliance with requirements of the Healthy Homes Standards?

Arakura Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is required in all Arakura and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate the conformance to all Healthy Homes Standards that apply or will be in force during the tenure of your rental home.

Starting 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply with the Healthy Homes Standard within 90 days of any new, renewed or varied lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Arakura

Rental properties in Arakura must have a fixed source of heat that is able to heat the main or largest living space to a minimum of 18degC, even during the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat needs to be fixed (i.e. not portable) with at least 1.5 horsepower in capacity, and must meet the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to determine if the existing installed heater(s) are sufficient or if you’ll need to "top up" with an additional heater. Open fires and unflued combustion heaters, such as portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating that you provide is electric heating or heat pump, it requirements to be equipped with the thermostat. This makes the heating more consistent and efficient. For most properties, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces the smaller fixed electric heater could be enough.

If the living area already has a permanent heating source like an air conditioner, it could need a top up to be able to meet the standards. Some types of heaters can’t be utilised to meet the quality since they’re either costly, not cost-effective to run, and/or unhealthy to run.
