Fines for Failing to Comply

Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed for an Arakura rental property, all Healthy Homes compliance items need to be taken care of within 90 days.

Since the 1st July of 2021, once a new or renewed lease is entered into on an Arakura rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to provide the information requested within 21 days of getting the notice, the tenant could be issued an infringement notice and be fined upto $750.

Additionally, there is also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or any other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

All the information on the Statement of Compliance needs to be current before the tenancy agreement can be signed. It must be updated throughout the tenancy as any related work is completed.

It is also crucial to note that landlords who have multiple rental properties may face additional fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in hearings.

Clearly, failure to comply with compliance with Healthy Homes requirements can hit your wallet hard, with massive fines as well as still having to meet compliance. Don’t risk your rental property, contact us today and request an house inspection performed for your rental property.

Healthy homes are important

Why is Healthy Homes Compliance so Important?

A majority of households rent in New Zealand and Arakura, and research suggests that rental houses are more likely to be older, colder, have less effective heating and are of lower quality than houses that are owned by the owner.

Moldy, damp and cold houses are associated with negative well-being outcomes, especially for ailments like colds and influenza, asthma, and heart diseases. Additionally, those who experience at least four major housing quality problems frequently have less satisfaction in their lives and lower psychological well-being.

Improve the quality of Arakura rental property can help tenants enjoy better mental and physical health as well as lessen disruption to work, learning and daily life due to diseases. Your investment will be safeguarded from mildew, mould and damp , which means lower costs for maintenance in the long-term.

The Healthy Homes Standards are a list of specific and minimum standards for Heating, Insulation Ventilation and Ventilation and Drainage, as well as Draught Stopping for Arakura rental properties.

Unreasonable Gaps & Holes

Draught Stopping Arakura

Draughts are a major cause of less temperature in households. A draughty home is more expensive to heat, which means wasting energy and resulting in higher bills.

If a draught could be felt from unreasonable gaps or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or the sound of a clear draught emanating from a gap or hole that is, it’s most likely a gap or hole which needs sealing in any way. Cracks or gaps with large gaps must be stopped permanently. Cracks that are greater than 3mm and allow air in or out within your home need to be sealed. In the case of an open fireplace isn’t being used, it may cause draughts and should be blocked off. Landlords and property managers are accountable for making sure such draughts are eliminated as far as imaginable.

There is no need to block up intentional gaps or holes in the building. For example, tiny gaps around doors and windows could be required to allow movement of the structure when the home is heated and cools so that they can still be closed and opened rather instead of being stuck. We will test the windows and doors as part of our Healthy Homes assessment of your rental property.

Heating Arakura

Arakura rental properties must have a fixed heating source which can warm the principal or the biggest living area to at minimum 18degC even on the winter coldest days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements to remain fixed (i.e. not portable) and at minimum 1.5 kW in heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool may be used to determine whether your current permanent heater(s) are adequate or if you’ll require to top up with an additional heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters are not considered acceptable heating options under The Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), then it must be equipped with the thermostat. This makes the heating more consistent and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. In certain situations, like small apartments an electric, fixed heater might be enough.

If the main living room is already equipped with a fixed heating source, such as an air conditioner, it might just require an upgrade in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard because they’re expensive, inefficient or are unsafe to operate.

Underfloor and ceiling insulation has been compulsory for all rent homes since July 1, 2019. All landlords and property managers are required to make sure that the insulation is in line with current standard. In some cases, old ceiling insulation as well as insulation within the sub floor space may need to be topped up or replaced.

A house that is well-insulated will reduce the risk of condensation and reduce the chances of mould and dampness and will also make an easier task for the household to hold the heat.

Insulation requirements to be in compliance with the R-values required for your area

The "R" is a symbol for thermal resistance and is a gauge of how well the insulation is able to resist heat flow. The more R-value is higher, the more effective the insulation.

Arakura Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about what’s inside the building; you have to ensure there is somewhere for rain, surface and ground water to go and to prevent it from getting into the building. When it is damp and moisture, it’s typically not apparent that it can cause a lot of trouble, causing damage to your investment and affecting your tenant’s health.

Rental properties require to be equipped with efficient drainage to get rid of rainwater, storm water and ground water, which includes the proper outfall or runoff. Making sure that water is able to go, and also that it can’t linger underneath the structures is a crucial aspect of maintaining your property’s dry.

Alongside a drainage system to avoid moisture ingress, if your rental is enclosed between your floor and ground, a ground water barrier must be constructed if it is reasonably practicable to do so.

The ground-moisture barrier typically an insulating sheet of polythene laid over the ground to stop any moisture in the ground from rising into the home. It also helps prevent from causing damage to the flooring insulation.
