Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied contract is signed on an Arakura rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on an Arakura rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not incorporated within a new, renewed or revised tenancy contract, there may be an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager is unable to supply the required information within 21 days from receiving the request, they may receive an infringement letter and be fined as high as $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers that provide false or misleading Healthy Homes Compliance Statement or any other information. The person liable for this fine is whoever is listed on the tenancy contract as the person renting the property It could also be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be current at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any necessary work related to it is finished.

It is important to remember that landlords with multiple rental properties could face greater penalties for non-compliance. The highest penalties are handed down only for serious breaches, and landlords with six or more properties can receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

When Do I need to be in compliance with The Healthy Homes Standards?

Arakura Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement throughout Arakura and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the conformance to any Healthy Homes Standard that apply or will apply during the tenancy of the rental property.

Starting 1 July 2021

  • Property managers and private landlords are required to make sure their rental properties comply to the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.

Heating Arakura

Rental properties in Arakura must have a fixed source of heating that can heat the largest or main living space to at least 18degC, even during the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements for it to be permanent (i.e., not portable) and at minimum 1.5 kW of heating capacity, and must meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to determine if the existing installed heater(s) are adequate or whether you will need to "top-up" with a new heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters aren’t considered to be suitable heating options for the Healthy Homes Standard.

If the heating system you offer is electric heating (or heat pump), it must be equipped with a thermostat. This makes the heating more consistent and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in certain instances like small apartments an electric, fixed heater might be enough.

If your main living space already has a fixed heating source, such as the heat pump, it might require a top up in order to comply with the standards. Certain kinds of heaters cannot be used to comply with the quality since they’re either expensive, inefficient and/or unhealthy to run.

Ventilation Arakura

Insulation for underfloor and ceilings is a requirement in all rental homes as of July 1st, 2019. Property managers and landlords have to make sure that the insulation is in line with the new standard.
