Fines for Failing to Comply

Furthermore, there’s also a penalty approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is listed on the tenancy contract as the person renting the property and it could be the landlord’s name or the property management company.

All information in the Compliance Statement needs to be accurate before the tenancy agreement can be signed. It is updated during the entire tenancy, as necessary work related to it’s finished.

It is also important to be aware that a landlord with multiple rental properties may receive more severe penalties for not complying. The highest penalties are reserved for serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

When Do I need to be in compliance with The Healthy Homes Standards?

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory for all Arakura and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the time of the first day of tenancy.

If the living area already has a central heating source, such as a heat pump, then it may require some additional energy to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Arakura

Each liveable space in the rental property should include at least one open doors or windows to offer natural airflow. In addition, high moisture areas such as kitchens and bathrooms should have an externally vented extractor fan to remove moisture.
