Fines for Failing to Comply

The information contained in the Compliance Statement requirements to be correct when the tenancy agreement is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It’s crucial to keep in mind that a landlord who own multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

Tenancies signed in the period between July 1st 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is required throughout Arakura and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.

Heating Arakura

Rental properties in Arakura must have a fixed heating source that can heat the living room to at least 18degC, even during the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

Insulation Arakura

Ceiling and underfloor insulation is required on all rental homes as of July 1st, 2019. All landlords and property managers are required to make sure that the insulation is up to the new standard.
