Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on an Alicetown rental property, all Healthy Homes compliance tasks must be done within 90 days.

The person responsible for this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property which could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is signed, and ideally it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It is important to keep in mind that landlords with several rental properties can face greater penalties for non-compliance. The most severe penalties are given for severe breaches, and landlords with at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is mandatory for all Alicetown and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
