Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for an Alicetown rental property, all Healthy Homes compliance items must be completed within 90 days.

The person responsible for this fine is the one who is identified on the tenancy agreement as the one who is leasing the property out which could be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be current at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s crucial to note that a landlord with multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are given for serious breaches, and landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies signed beginning on 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory in all Alicetown and New Zealand rental homes where it’s reasonably practicable to put in.

Beginning 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.
