Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed for an Alicetown rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, when a new or renewed lease is entered into on an Alicetown rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The person who is liable for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property, so it could be the name of the landlord as well as the property management company.

All information in the Compliance Statement needs to be current before the tenancy agreement can be signed. It should be maintained during the entire tenancy, as related work is completed.

It’s important to remember that a landlord with multiple rental properties could face additional fines for non-compliance. The highest penalties are reserved for serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Alicetown Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement to all Alicetown and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with all Healthy Homes Standards that apply or will be applicable during the tenure of their rental properties.

  • All households rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

However, in some cases like apartments with small spaces, a smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source, like a heat pump, then it might just need some additional energy to ensure it meets the requirements. Certain kinds of heaters aren’t able to be used to achieve the quality as they are either costly, not affordable to run, and/or unhealthy to run.
