Fines for Failing to Comply
Since the 1st July of 2021, when a new, renewed or varied contract is signed on an Alicetown rental property, all Healthy Homes compliance work need to be finished inside of 90 days.
From the 1st of July in 2021, once a new or renewed lease is entered into on the Alicetown rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Inability to adhere to all of the Healthy Homes Standards within the anticipated timeframe could result in the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included within the renewal, new or revised tenancy agreement there may be additional penalties or an infringement fee.
Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager fails to provide the required information within 21 days of receiving the request, they can receive an infringement notification and be fined up to $750.
In addition, there’s also a penalty of approximately $900 for landlords or property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is named on the tenancy agreement as the one who is renting the property which could be the name of the landlord as well as the property management company.
All information in the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed. It should be kept updated through the tenancy period as necessary work related to it’s finished.
It is also important to keep in mind that a landlord with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and as much as $100,000 in hearings.
